These Terms of Use ("Terms") constitute the agreement between Poddy ("Platform") and you ("User"). By using the Platform, you agree to these Terms, the Privacy Policy, and the Community Rules. If you do not agree, please do not use the Platform.

1. Description of the Service

Poddy is a social podcasting platform. The Platform offers free-plan content discovery and basic listening, as well as a paid Premium membership plan. Under Premium membership:

• Ad-Free Experience: Uninterrupted listening without ads across all content consumption.
• Mike Feature: An automated service that creates and delivers a personalized podcast compiled from the user's selected news sources. News sources are chosen by the user; content is refreshed daily or at the selected interval.

2. Eligibility

• You must be 18 years of age to use the Platform.
• If accepting on behalf of a business, you declare you are authorized to bind that entity.
• Previously permanently banned users may not use the Service.
• You must use the Service in compliance with the applicable laws of your country.

3. Use of the Service: Permissions and Restrictions

Subject to these Terms, you are permitted to use the Platform for personal purposes. The following are strictly prohibited:

• Copying, reproducing, or reverse engineering any part of the Platform without authorization.
• Accessing the Service with bots, scrapers, or automated tools.
• Using the Mike feature to compile copyrighted content without authorization.
• Attempting to circumvent security measures or gain unauthorized access.
• Using the Platform to spread spam, fraud, or malware.
• Sharing the Premium membership or offering it commercially without authorization.

4. Content and Conduct

You are responsible for all your conduct, including your podcaps and all behavior on the Platform. You agree to comply with the Community Rules.

4.1. Mike Feature Usage Rules

Personalized podcasts created with the Mike feature are based on publicly available news information from your selected sources. This content is for personal use only; it may not be reproduced or redistributed for commercial purposes without Poddy's express written permission. You may not use the Mike feature or present the generated content for false, misleading, or harmful purposes.

5. Intellectual Property Rights

The Platform's software, design, "Poddy" and "Podear" trademarks, logo, and all content belong to Podear Limited or its licensors. These Terms grant you only the right to use the Service.

6. Premium Membership, Fees, and Payment

The scope and renewal terms of Premium membership fees are specified on the purchase screen. Payments are collected via Iyzico. For refund, cancellation, and withdrawal terms, see Delivery, Return & Cancellation and the Distance Sales Agreement. We reserve the right to change prices prospectively.

7. Account Suspension and Termination

By you: You may stop using the Service at any time and cancel your Premium subscription.

By us: We may suspend or terminate your access if you violate these Terms, Community Rules, or misuse the Mike feature. Where possible, we will notify you of the reason.

8. Disclaimer of Warranties

The Service is provided "as is." No warranty is given regarding the currency, accuracy, or completeness of personalized podcast content created with the Mike feature. Your statutory consumer rights are reserved.

9. Limitation of Liability

To the maximum extent permitted by law, the Platform is not liable for news inaccuracies in Mike content, data loss, or indirect damages. The SELLER's total liability is limited to the Premium membership fee paid in the last 12 months.

10. Governing Law and Jurisdiction

Turkish law applies to these Terms. Consumer Arbitration Committees and Consumer Courts have jurisdiction for consumer transactions.

11. Changes to the Terms

We may update these Terms from time to time. The current version is published on this page; we will reasonably announce significant changes.
